TERMS AND CONDITIONS OF THE ONLINE STORE
Effective as of April 1, 2026

§1 General Provisions

1. These Terms and Conditions set forth the rules for using the online store available at www.mechanizacja.pl

4. The Terms and Conditions specify in particular:
   • rules for placing orders,
   • terms and conditions for concluding sales contracts,
   • rights and obligations of the parties,
   • complaint and return procedures.

§2 Definitions

• Customer – an entity making a purchase in the store,
• Consumer – a natural person making a purchase not directly related to business activity,
• Entrepreneur with consumer rights – a natural person conducting business activity who exercises consumer rights,
• Entrepreneur – an entity making a purchase as part of professional business activity,
• Seller – the store owner,
• Store – an online store operating on the WooCommerce platform,
• Goods – products available in the store’s inventory.

§3 Terms of Use

1. To use the store, you need:
   • a device with Internet access,
   • an up-to-date web browser,
   • an active email address.
2. It is prohibited to provide illegal content.
3. The customer is required to provide accurate information.

§4 Placing Orders

1. Orders can be placed via the store’s website 24 hours a day.
2. To place an order, the Customer:
   • selects the Product,
   • adds it to the cart,
   • fills in the details,
   • selects the delivery and payment method,
   • confirms the order.
3. Placing an order constitutes an offer to enter into a sales contract.
4. The contract is concluded upon confirmation of the order by the Seller.

§5 Prices and Payments

1. The prices listed in the store are gross prices (PLN).
2. Shipping costs are indicated during the ordering process.
3. Available payment methods include:
   • bank transfer,
   • online payments,
   • cash on delivery (if available).

§6 Delivery

1. Delivery is available within Poland and select countries.
2. The order processing time is indicated next to the product or in the shopping cart.
3. The total delivery time includes order preparation and shipping.

§7 Right of Withdrawal

1. The consumer has the right to withdraw from the contract within 14 days without giving a reason.
2. The period begins upon receipt of the Goods.
3. To exercise the right of withdrawal, you must inform the Seller of your decision.
4. The Goods must be returned within 14 days of notifying the Seller of the withdrawal.
5. The cost of return is borne by the Customer, unless otherwise agreed.

§8 Right of Withdrawal – Business Customers

1. The right to withdraw from a distance contract is available to:
   a) A consumer,
   b) A natural person entering into a contract directly related to their business activity, provided that the contract is not of a professional nature for them.
2. Entrepreneurs other than those indicated above are not entitled to the right of withdrawal.
3. If the entities specified in paragraph 1 exercise the right of withdrawal, the provisions of §7 shall apply accordingly.
4. The Seller has the right to verify the nature of the purchase based on the Buyer’s business profile.
5. It is presumed that the purchase of goods related to the store’s offer is of a professional nature, which excludes the right of withdrawal for entrepreneurs.

§9 Exclusions from the Right of Withdrawal

The right of withdrawal does not apply, among other things, in the case of:
• custom-made goods,
• perishable products,
• products in sealed packaging after it has been opened (for hygiene reasons).

§10 Complaints

1. The Seller is responsible for the conformity of the Goods with the contract.
2. Complaints may be submitted via email or in writing.
3. The complaint should include a description of the problem and the Customer’s details.
4. Complaints are processed within 14 days.

§11 Personal Data

The rules for processing personal data are set forth in the Privacy Policy available on the store’s website.

§12 Newsletter

1. The newsletter is sent only with the user’s consent.
2. Consent may be withdrawn at any time.

§13 Final Provisions

1. These Terms and Conditions are governed by Polish law.
2. In matters not covered herein, the provisions of generally applicable law shall apply.
3. The Seller may amend these Terms and Conditions for valid legal or organizational reasons.
4. For orders placed before the Terms and Conditions were amended, the version in effect at the time of purchase applies.
